Terms of service
Plain terms. The short version: we deliver documents produced by automated testing and expert-system analysis with human review; you adopt them as your own; we do not certify anything.
1. The service
Conformance Desk (“we”) tests the website or web application you identify at checkout (the “site”) and delivers the documents listed for the product you buy. Testing is automated (a crawl in a real browser with rule-based engines and custom probes) with expert-system assessment of the evidence, and each draft is reviewed by a person before release. Manual testing with assistive technology is not part of the service unless you buy it separately.
2. What the documents are
The documents describe findings and levels of support observed on the pages tested on the report date. A conformance report is prepared as a draft for you to adopt and publish as your own declaration. Nothing we deliver is a certification, a legal opinion, a guarantee of conformance, or a statement that the site complies with any law. Automated methods cannot settle every criterion; where they cannot, the documents say so.
3. Your authority and your site
You confirm that you own or are authorised to commission testing of the site, including any account you provide. Testing generates requests to the site at up to one per second. You are responsible for the accuracy of the product information and answers you give us; they appear in the report.
4. Test accounts
If you provide a test account it is encrypted in your browser to a key held only by our testing service, used solely to test the site, and deleted 30 days after delivery. Do not provide an account with access to real personal data; use a test account.
5. Delivery, re-review, refunds
Delivery is targeted within three business days of payment and, where needed, of a working test account. One re-review of the same pages within 14 days of delivery is included. Full refund if the crawl has not started or the site is out of scope (native mobile apps; logins requiring a code sent to a person). No refunds after delivery.
6. Liability
Our total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, or for claims by third parties based on the documents. The documents are for your use; third parties may not rely on them against us.
7. Intellectual property
On payment you own the delivered documents and may adopt, edit and publish them. Our templates, methods and software remain ours. VPAT is a registered trademark of the Information Technology Industry Council, used to describe the report format.
8. Governing law
These terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable there. Disputes are resolved in the courts of that province.
